Welcome to Bookingenie Ltd! We appreciate you taking the time to read and understand these Terms of Service (the “Terms”).

These Terms, together with the booking confirmation email (the “Booking Confirmation”), govern the legal framework under which the Travel Services are made available to you through our Service. They also cover any interactions or communications you may have with us in connection with using the Service.

Your use of our Service is subject to your acceptance of these Terms. By making a booking or using the Service, you acknowledge and agree to be bound by these Terms. If you do not accept these Terms, you must refrain from using our Service or making any bookings.

Changes to Terms: We reserve the right to modify these Terms at any time. Your continued use of our Service after any updates or changes constitutes your acceptance of the updated Terms. We recommend saving or printing a copy of these Terms for your reference.

Definitions:

• "we", "us", or "our" refers to Bookingenie Ltd, having its registered office at Quatre Bornes, Mauritius.

• "our Group of Companies" refers to Bookingenie Ltd and its subsidiaries and affiliates.

• "our Partners" refers to affiliated, co-branded, or linked websites through which our Group of Companies offers content or services.

• "our Service" refers to the provision of our website, apps, and online tools.

• "Travel Provider" refers to the supplier of the Travel Services made available to you through our Service.

• "Travel Services" refers to the services provided by the Travel Providers, such as accommodation bookings or other travel-related services.

• "you" refers to the user, traveler, or customer utilizing our Service or making a booking.

Section 1: Rules and Restrictions

In addition to these Terms, you will be subject to the terms and conditions imposed by the Travel Providers (including, but not limited to, accommodation providers) which apply to your booking (“Rules and Restrictions”).

Before making a booking, you must accept the Rules and Restrictions provided by the Travel Provider, including payment terms, refund policies, penalties, availability, restrictions, and any other relevant terms.

Failure to adhere to a Travel Provider's Rules and Restrictions may result in the cancellation of your booking, denial of access to the Travel Service, and the forfeiture of any payments made. In such cases, we or the Travel Provider may charge your account for any incurred costs.

Consumer to Consumer Transactions: Travel Providers on our Service may operate as individuals (non-professional) or businesses (professional). If you enter into an agreement with an individual Travel Provider, consumer law will not apply to that transaction.

Section 2: Using Our Service

Our Rules:

• We provide our Service to assist you in finding information about and booking Travel Services. It is intended solely for personal and non-commercial use.

• We do not present an exhaustive list of available travel options. Travel Services may also be accessible through other channels beyond our Service.

Your Obligations: By using our Service, you agree:

• To use it for personal, non-commercial purposes only.

• To be at least 18 years of age and have the legal authority to enter into binding contracts.

• To use the Service lawfully and in compliance with these Terms.

• To provide accurate, current, and complete information when using the Service.

• To protect your account information and ensure that any use of your account is authorized.

If you are booking on behalf of others, you are responsible for obtaining their authorization and ensuring they understand and agree to the terms of the booking.

Prohibited Actions: You agree not to:

• Make any false or fraudulent bookings.

• Use automated tools (such as robots or scrapers) to access, monitor, or copy content from our Service.

• Bypass any security measures or attempt to impose an unreasonable load on our infrastructure.

• Deep link, "frame," or mirror any part of our Service into another website.

Access: We reserve the right to deny access to our Service at any time for any valid reason, including when such access is deemed unreasonable or improper.

Account Creation: To create an account, you must be at least 18 years old. Your Bookingenie account grants access to other platforms within the Bookingenie Group under the same credentials. Please refer to our Privacy Statement for information on deleting or accessing your account.

Section 3: Confirming a Booking

A Booking Confirmation will be sent to the email address provided during your booking. This confirmation will include the essential details of your Travel Service(s) and the associated price.

If you do not receive your Booking Confirmation within 24 hours of your booking, please contact us immediately : bookingenie.com.

Section 4: Payment

Pricing: The price of your Travel Service(s) will be displayed on our Service, except in cases of evident pricing errors. Prices are dynamic and subject to change. Once a booking is confirmed, any price discrepancies will be addressed by offering the correct price or canceling the booking without penalty.

Taxes: Prices may include various taxes, such as value-added tax (VAT), occupancy tax, or other similar charges. You may be required to pay additional local taxes (e.g., city or tourist taxes) that are not included in the displayed price. These taxes may change between the booking date and the date of your stay, in which case you may be required to pay the difference.

Payment Processing: Payments for bookings will be processed by third-party payment providers. The specific payment processor and the applicable payment method will be noted on the booking page.

Section 5: Third-Party Booking Services

If you are redirected to a third-party booking service (e.g., for car rental or flights), please note that any bookings made through these services are separate from those made directly through Bookingenie Ltd. We are not liable for third-party bookings, except where they form part of a Linked Travel Arrangement as defined in Section 6D. In such cases, we may provide refunds for services not performed due to our insolvency.
